Schuylkill County Business Owner Charged with Selling THC Products from Tobacco Shop

Police make several undercover purchases to confirm

The owner of a Schuylkill County tobacco shop is facing drug charges after police say he was selling THC products from his store.

According to court documents filed this week, police in Pottsville say they acted on a tip received in July 2024 regarding the Pottsville Tobacco Hut, located on Nichols St. That tip indicated the shop was selling products that contained THC.

On the evening of July 15 last year, an undercover officer went into Pottsville Tobacco Hut and purchased one Budget vape and four Raw-branded cannabis wraps for a total of $43.89. The clerk at the store that day was its owner, Hamiz Malik, of Bethlehem.

Police say a field test of the wraps purchased that day returned a positive result for marijuana. They were sent to a forensics lab for further testing.

On Sept. 17, police say they conducted another purchase from the store using an undercover officer. That officer purchased two Raw-branded cannabis wraps for a total of $12.27. They were once again field-tested and again returned a positive for marijuana, police say.

The forensics lab results on the items in the first purchase were returned to police on Oct. 7 and the tests reportedly confirmed the presence of marijuana. They allegedly contained a THC content greater than 0.3%.

On Oct. 28, an undercover officer went to Pottsville Tobacco Hut again and purchased a Raw cannabis wrap for $4.24. The officer got a receipt for that purchase, according to the court documents. A field test on it once again returned a positive result for marijuana.

That same day, Magisterial District Judge James Reiley signed a request for a search warrant on Pottsville Tobacco Hut and it was executed the following day.

Police say they entered the shop as it opened at 10 a.m. on Oct. 29. They were met by a clerk, who later contacted Malik, who arrived at the store while the search warrant was being executed. Police say a large number of items were seized during their sweep of the store. The items seized had packaging materials indicating they contained THC, DELTA-8, DELTA-9, cannabis, or a variant of those substances.

One of the items seized, police say, was labeled “MUHA MEDS (D8)” and indicated it was a Schedule I controlled substance.

On Nov. 3, Malik came to Pottsville City Hall for an interview with police. Malik reportedly provided police with a receipt for the items he purchased from MUHA MEDS. He reportedly told Police that he would purchase THC-related items from different wholesalers to stock his store.

In February 2025, police say they received lab results of the items seized during the execution of that search warrant in October 2024. Police itemized the products and what the lab results reportedly show in their affidavit against Malik:

  • D1/2.1 (Luxx Pre-Roll “2 Grams”) contained marijuana, THC was greater than 0.3%, Schedule I (9 Jars)
  • D3/2.2 (Luxx Vibey Shortie Roll) contained marijuana, THC was greater than 0.3%, Schedule I (12 Jars)
  • D4/2.3 (Luxx Exotic Keif THCA Shortie) contained marijuana and delta 8, THC was greater than 0.3%, Schedule I (10 Jars)
  • D5/2.4 (Luxx 2.0 Exotic THC-A Flower) contained marijuana, THC was greater than 0.3%, Schedule I (9 Jars)
  • D6/2.5 (Luxx Diamond Infused Premium Flower) contained marijuana, THC was greater than 0.3%, Schedule I (11 Jars)
  • D7/2.6 (Phantoms Cannabliss Gummies) contained delta 8, Schedule I (9 Jars)
  • D8/2.7 (MUHA MEDS Vape Cartridge) contained delta 8 and THC, THC was greater than 0.3%, Schedule I (12 boxes)
  • D9/2.8 (Phantoms Cannabliss Disposable Vape) no controlled substances detected (10 boxes)
  • D10/2.9 (Sauce’D Vape) contained delta 8, Schedule I (11 boxes)
  • D11/2.10 (SIC Canna Gummies) contained delta 8, Schedule I (13 bags)
  • D12/2.11 (Luxx Vibey Vape) contained delta 8, Schedule I (20 boxes)
  • D14/2.12 (Cutleaf THCA Hemp Flower) contained marijuana, THC was greater than 0.3%, Schedule I (6 bags)
  • D15/2.13 (“Purple” Vape) contained delta 8, Schedule I (12 bags)
  • D16/2.14 (Cereal Labs Vape) contained delta 8, Schedule I (26 boxes)
  • D17/2.15 (LUXX Groovy Vape) contained delta 8, Schedule I (30 vapes)
  • D18/2.16 (Half Bak’d Gummies) contained delta 8, Schedule I (90 bags)
  • D19/2.17 (Luxx Vibey 2.0 Cartridge) contained delta 8, Schedule I (23 boxes)
  • D20/2.18 (Luxx Vyvey Pre-roll) contained marijuana and delta 8, THC was greater than 0.3%, Schedule I (94)
  • D21/2.19 (Silly Farms Magic Mushroom Chocolate bar) contained delta 8, Schedule I (6)
  • D22/2.20 (Float Trippy Hippy Gummies) Unknown percentage of THC (11 bags)
  • D24/2.22 (Luxx snow cone Pre-roll) contained marijuana and delta 8, THC was greater than 0.3%, Schedule I (44 bags)

In addition to the THC products, police say 21 bags of Amanita Mushroom Gummies tested positive for psilocyn, which is also a controlled substance.

Packaging materials were also seized during the search warrant execution. Labeling on them indicted they contained Schedule I controlled substances. The packaging materials, police say, were used to hold “bulk flower.”

Malik is facing charges of delivery of a controlled substance, possession with intent to deliver drug paraphernalia, two counts of possession with intent to deliver a controlled substance, and two counts of possession of a controlled substance.

He was arraigned before Reiley on Wednesday afternoon in Pottsville and released on $20,000 unsecured bail. A preliminary hearing has been scheduled for July 28.
